01 / About these terms

These Terms of Service govern access to and use of moviadesign.studio. Moviadesign Studio is a shared brand presence of the independently operating designers Jakob List and Sergio La Gattuta. Both providers act legally and financially in their own name and on their own account. Further provider information is available in our Imprint.

These Terms describe the conditions applicable to the use of this Website. They do not replace any separate agreement entered into with a client for professional services.

02 / Website purpose

The Website presents information about Moviadesign Studio, the professional capabilities and experience of its individual team members, and their approach to experience design. Website content is provided for general information and portfolio purposes. It is not a binding offer, professional advice or a promise that a particular service, outcome, schedule or team is available.

03 / Project enquiries

You may use the contact form or published contact details to discuss a potential project. Sending an enquiry does not create a contractual relationship, exclusivity obligation or commitment to perform services.

If a project proceeds, the relevant proposal, order confirmation, statement of work or agreement will clearly identify either Jakob List or Sergio La Gattuta as the respective contracting service provider. The respective agreement will govern scope, deliverables, fees, timing, intellectual property, confidentiality and other project-specific terms.

04 / Acceptable use

You agree not to use the Website to:

  • break any applicable law or infringe another person’s rights;
  • introduce malicious code, interfere with security or disrupt the Website;
  • attempt unauthorised access to systems, accounts or data;
  • scrape, copy or extract Website content at scale without written permission;
  • submit unlawful, misleading, abusive or unsolicited commercial material; or
  • misrepresent your identity or affiliation with another person or organisation.

05 / Intellectual property

Unless otherwise stated, the original content of this Website, including its design, text, graphics, motion design, software, images and video, is owned by Jakob List and/or Sergio La Gattuta or used under rights available to them. Third-party names, trademarks, logos and other protected material remain the property of their respective rights holders.

No licence or other right to use Website content is granted except for ordinary viewing of the Website. Website content may not be reproduced, adapted, published, distributed, sold, licensed or commercially exploited without permission from the respective rights holder.

06 / Brand and logo references

Brand names and logos are shown solely to indicate the professional experience of the individual MOVIA team members. In some cases, work was performed indirectly through agencies, consultancies or other contracting partners. No direct commercial relationship, endorsement or partnership with MOVIA is implied.

07 / Third-party services

The Website may contain links to third-party websites and services, including social-media platforms.

These third-party websites and services are operated independently and are subject to their own terms, privacy policies and practices.

Jakob List and Sergio La Gattuta do not control third-party websites and are not responsible for their content, availability or practices.

08 / Availability and accuracy

We make reasonable efforts to keep the Website accurate, secure and available. However, the Website is provided for general information and portfolio purposes and availability cannot be guaranteed at all times.

09 / Limitation of liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law. In particular, liability for intentional conduct, gross negligence and injury to life, body or health remains unaffected.

Where legally permissible, liability for ordinary negligence is limited to breaches of essential obligations and to damages that were reasonably foreseeable and typical in the circumstances.

Liability relating to separately commissioned professional services is governed by the agreement entered into with the respective service provider.

10 / Applicable Law

The use of this Website is subject to applicable statutory law. Any separate client agreement may contain its own provisions regarding governing law and jurisdiction. Mandatory statutory rights, including applicable consumer protections, remain unaffected.

We may update these Website Terms to reflect changes to the Website or applicable legal requirements. The current version and its effective date are published on this page. Changes to these Website Terms do not modify existing client agreements unless expressly agreed between the relevant parties.
